Every single day, the U.S. government gathers and stores more than a billion phone calls, emails, text messages, photographs and Internet searches.  Just about every form of electronic communication that you can possibly imagine is being harvested.  In fact, it has been reported that NSA personnel gather 2.1 million gigabytes of data every hour.  This is being done even though it is a blatant violation of the U.S. Constitution.  Sadly, most Americans do not even know what the Fourth Amendment actually says.  For those that do not know, the Fourth Amendment says the following: “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

Unfortunately, our leaders have totally abandoned the Constitution.  They seem to believe that they have the right to look through our electronic communications any time they want and that we should not complain about it.  As you will see below, workers at the NSA have even eavesdropped on very intimate conversations between soldiers serving in Iraq and their female loved ones back home.  What kind of sick person would do such a thing?  Sadly, the truth is that we have allowed ourselves to become a “Big Brother society”, and we are an utter disgrace to the millions of brave men and women who have died to defend our freedoms.

The Obama administration the communication records of millions of US citizens are being collected indiscriminately and in bulk – regardless of whether they are suspected of any wrongdoing.  The Obama administration sees nothing wrong with this at all.

Will some of our other “leaders” step forward and condemn this blatant violation of the U.S. Constitution?

Sadly, so far most of our politicians are rigorously defending the program.  Just check out how some prominent members of Congress responded to this story…

Senator Dianne Feinstein: “There is nothing new in this program. The fact of the matter is, that this was a routine three-month approval under seal that was leaked”

Senator Lindsey Graham: “If we didn’t do it, we’d be crazy”

Senator Saxby Chambliss: “This is nothing particularly new. This has been going on for seven years under the auspices of the (Foreign Intelligence Surveillance Act) authority and every member of the United States Senate has been advised of this”

Senate Majority Leader Harry Reid: “Everyone should just calm down and understand this isn’t anything that is brand new. It’s been going on for some seven years. And we’ve tried often to try to make it better, and we’ll continue to do that”

But the collection of phone call metadata is just the tip of the iceberg.

The truth is that government surveillance of Americans citizens goes far beyond what you are being told.

In fact, the Washington Post has just come out with an article about a highly classified program known as PRISM that involves the federal government “tapping directly into the central servers” of nine top Internet companies…

The National Security Agency and the FBI are tapping directly into the central servers of nine leading U.S. Internet companies, extracting audio, video, photographs, e-mails, documents and connection logs that enable analysts to track a person’s movements and contacts over time.

The highly classified program, code-named PRISM, has not been disclosed publicly before. Its establishment in 2007 and six years of exponential growth took place beneath the surface of a roiling debate over the boundaries of surveillance and privacy. Even late last year, when critics of the foreign intelligence statute argued for changes, the only members of Congress who knew about PRISM were bound by oaths of office to hold their tongues.

So what Internet companies are involved?  Most of the names will be extremely familiar to you…

The technology companies, which participate knowingly in PRISM operations, include most of the dominant global players of Silicon Valley. They are listed on a roster that bears their logos in order of entry into the program: “Microsoft, Yahoo, Google, Facebook, PalTalk, AOL, Skype, YouTube, Apple.” PalTalk, although much smaller, has hosted significant traffic during the Arab Spring and in the ongoing Syrian civil war.

Dropbox , the cloud storage and synchronization service, is described as “coming soon.”

Another whistleblower, former NSA code breaker William Binney, has come forward with some astounding details about what is actually happening over at the NSA.  The following is from a recent Business Insider article…

Binney — one of the best mathematicians and code breakers in NSA history — worked for the Defense Department’s foreign signals intelligence agency for 32 years before resigning in late 2001 because he “could not stay after the NSA began purposefully violating the Constitution.”

He’s detailed how, ever since 9/11, the NSA has run a top-secret surveillance program that amasses electronic data — phone calls, GPS information, emails, social media, banking and travel records, entire government databases — and analyzes the information “to be able to monitor what people are doing” and who they are doing it with.

So exactly how much information are we talking about?

Overall, Binney claims that the NSA has gathered approximately “20 trillion transactions” involving U.S. citizens.

And other NSA whistleblowers claim that the agency “has the capability to do individualized searches, similar to Google, for particular electronic communications in real time through such criteria as target addresses, locations, countries and phone numbers, as well as watch-listed names, keywords, and phrases in email.”

But this is not supposed to be happening.  The NSA is not supposed to be spying on U.S. citizens and it is a clear violation of the U.S. Constitution.

But they are doing it.  In fact, they are gathering so much information on all of us that they needed to build a brand new data storage center out in Utah.

The NSA says the Utah Data Center is a facility for the intelligence community that will have a major focus on cyber security. The agency will neither confirm nor deny specifics. Some published reports suggest it could hold 5 zettabytes of data. (Just one zettabyte is the equivalent of about 62 billion stacked iPhones 5′s– that stretches past the moon).

Why do they need so much storage space?

Well, after you start putting the pieces together, it becomes very clear.

They are illegally spying on all of us, and the American people need to be told the truth.

But of course there are always numbskulls out there that say things like this…

“I don’t have anything to hide so I don’t care if they watch everything that I do.”

Really?

If you think that way, perhaps you will change your mind after you read what some NSA employees have been doing.  The following is from an article posted on theatlanticwire.com…

And the NSA would never abuse its awesome surveillance power, right? Wrong. In 2008, NSA workers told ABC News that they routinely eavesdropped on phone sex between troops serving overseas and their loved ones in America. They listened in on both satellite phone calls and calls from the phone banks in Iraq’s Green Zone where soldiers call home. Former Navy Arab linguist, David Murfee Faulk described how a coworker would say, “Hey, check this out… there’s good phone sex or there’s some pillow talk, pull up this call, it’s really funny, go check it out.” Faulk explained they would gossip about the best calls during breaks. “It would be some colonel making pillow talk and we would say, ‘Wow, this was crazy.’”

We live during a time when government agencies are massively abusing their powers.  We have seen this recently with the IRS, the Justice Department and now with the NSA.

But so far, most Americans don’t seem too upset by all of this abuse of power.  Most Americans are so apathetic that they seem content to let the government get away with almost anything.

In the end, America will get the government that it deserves.  If Americans do not stand up now and speak out, it will be a signal to the government that this kind of behavior is okay and we will see even more of it.

The U.S. Government and other governments around the world manufacture terrorism in order to instill fear in its citizens which results in mass surveillance and actual acts of terrorism. Think of it this way: Your neighbor bombs your house for no reason or to get one person out of a large family. What is the first instinctive feeling that comes over you? Fear. What is the next? Anger! That leads to revenge! So, you plot to do something as damaging or worse to get even with your neighbor, don’t you? The U.S. Government has become masters of manipulation when it comes to our feelings, and they want us to fear instead of fight (“fight or flight” reaction). The federal government and all of its crazy agencies have consistently violated our Constitutional rights while stripping them away along with what is left of the Bill of Rights. They have shown a remarkable ability to bring out mass distrust as a result of their actions. For every action there is a reaction. What will your reaction be? Will you let that neighbor instill fear in you, and huddle in seclusion while they continue to bully you and make you fear them because they have the power to do so? Or will you rise up, and let them know that you rightfully distrust them, and in the process, strip them of the power hungriness that they thrive off of? Our government has made us gullible, naive, ignorant, fearful, complacent and short-sighted for a reason, and that reason is to control us while they suck up all the greed and power control like the imperialist, tyrannical nation that we allowed our government to let us become as a whole. Other nations are not so much fearful of us anymore, however they are angry at us for our actions. It is only a matter of time before they react, and I do not think the average American, Democratic or Republican, wants another nation or rogue terrorist organization attacking us on our soil. Let us be smarter than the government that created these problems for us, and work together in a bi-partisan effort to rid corporate-run government of the historical and colossal amount of corruption due to GREED and POWER, the two most evil words on the face of the earth, that we allowed our government to become overrun with! What do Google, AOL, Skype, Facebook, Apple, Hotmail and Yahoo all have in common? They have all been caught turning over private user data to the government’s spy agency, the NSA. All these companies routinely turn over the emails, voice calls, text chats, photos, files and even logins and passwords of their users, including Americans.

“There is a massive apparatus within the United States government that with complete secrecy has been building this enormous structure that has only one goal,” journalist Glenn Greenwald recently told Piers Morgan (who knows all about spying and hacking people’s private data). “And that is to destroy privacy and anonymity not just in the United States but around the world.”

Tech companies rush to issue (false) denials

Immediately after these revelations surfaced over the past few days, all these companies began denying any involvement with the NSA. “Google CEO Larry Page and Facebook chief executive Mark Zuckerberg are denying reports that depict two of the Internet’s most influential companies as willing participants in a secret government program that gives the National Security Agency unfettered access to email and other personal information transmitted on various online services,” reports the San Francisco branch of CBS News.

But what nobody is yet revealing is that all these companies are required by law to LIE to their own customers about secret government surveillance.

The Foreign Intelligence Surveillance Act, you see, makes it a federal crime for any company participating in the surveillance to publicly acknowledge the existence of that surveillance. Thus, executives at Facebook, Google, Skype and others would all face arrest and federal prosecution as “terrorists” if they admitted the truth to their own users.

That’s just how far down the rabbit hole this government surveillance program goes: Not only does the government spy on you and everything you do — “they quite literally can watch your ideas as you type” — the government can also force all the tech companies cooperating with the spying to publicly deny the existence of the program.

The New York Times goes on to report:

In at least two cases, at Google and Facebook, one of the plans discussed was to build separate, secure portals, like a digital version of the secure physical rooms that have long existed for classified information, in some instances on company servers. Through these online rooms, the government would request data, companies would deposit it and the government would retrieve it, people briefed on the discussions said.

This is how companies like Google and Facebook can claim, with a straight face, that the NSA doesn’t have “backdoor access to our servers.” They don’t need it! What actually happens is that Google, Facebook, Yahoo and others simply deposit all user data at another location — a “gateway” where the NSA copies it off.

Now you understand how to correctly parse this fake denial by Google’s chief executive Larry Page, who says, “The U.S. government does not have direct access or a ‘back door’ to the information stored in our data centers.”

It doesn’t need “direct access.” It has INDIRECT access that was set up by Google!

DHS spying on Peaceful Demonstrations and Activists

Government documents obtained by the Partnership for Civil Justice Fund (PCJF) through its FOIA records requests reveal that the Department of Homeland Security (DHS), an agency created after the September 11 attacks under the rubric of combating terrorism, conducts daily monitoring of peaceful, lawful protests as a matter of policy.

Functioning as a secret political police force against people participating in lawful, peaceful free speech activity, the heavily redacted documents show that the DHS “Threat Management Division” directed Regional Intelligence Analysts to provide a “Daily Intelligence Briefing” that includes a category of reporting on “Peaceful Activist Demonstrations” along with “Domestic Terrorist Activity.” (p. 68)

The PCJF has obtained thousands of pages of documents pursuant to its Freedom of Information Act demands and made them available for public viewing. The newly obtained  documents show coordination and intelligence monitoring by the DHS, the FBI, the NYPD and other law enforcement agencies of “Occupy-type” protests.

The documents show the routine use of Fusion Centers for intelligence gathering on peaceful demonstrations as well as the use of DHS’ “Mega Centers” for collection of surveillance information on demonstrations.

One document also shows the DHS engaging in what appears to be “off the books” intelligence gathering as one DHS agent writes in response to a request for information on the Occupy movement in New England, “This meeting should be finishing up soon and I’ll have access to a non-DHS computer that will allow me to do more looking.” (p. 6)

The first trove of FBI documents obtained by the PCJF in December 2012 exposed that the FBI treated the Occupy movement, even before the first tent went up in lower Manhattan, as a potential criminal and terrorist threat in spite of the fact that the FBI acknowledged that the OWS organizers explicitly called for peaceful protests.

The release  and PCJF analysis of the documents in December received significant media attention.

The new documents reveal DHS surveillance of protests in Asheville, NC; Tampa; Ft. Lauderdale; Jacksonville; Lansing, MI; Denver; Kansas City; Los Angeles; Boston; Dallas; Houston; Minneapolis; Miami; Jersey City; Phoenix; Lincoln, Nebraska; Chicago; Salt Lake City; Detroit and others.

In preparation for planned protests in New York City on October 15, 2011, the DHS documents show coordination between federal and local authorities to use New York City’s permitting scheme to frustrate, obstruct or stop free speech activities.

In the case of the New York City protest, the documents reveal how even the most elementary exercise for conducting a lawful protest activity was the subject of information sharing and cooperation between federal and local law enforcement agencies. This was the case when the Malcolm X Grassroots Movement sought a permit for a march with the purpose, as the DHS states, “to recognize the African slaves used to build Wall Street.” DHS reports on how the NYPD denied the sound permit for the planned activity and how the permit application was “kicked back and forth by the City, GSA and NPS. …” (p. 35)

As the federal and local governments and law enforcement agencies engaged in a concerted, coordinated crackdown to evict Occupy protests from public spaces in the last months of 2011, DHS officials shared and coordinated strategies. For instance, the DHS District Commander in Detroit directly communicated with a law enforcement official who was “tasked with coming up with an exit strategy for us.” After writing that he had heard in the news that encampments were “broken up in California and Georgia,” the DHS District Commander continued, “What is the plan for the Occupy Detroit group in Grand Circus Park? I have been reporting daily and sending it up.” (p. 115)

The documents show a Department of Homeland Security that appears obsessed with the question of whether any and all protests that are being surveilled receive media attention and coverage. Reporting within the DHS on media coverage of First Amendment protected activities, even in the smallest places, appears to be a routine part of DHS intelligence reports. None of the documents explain why media coverage of peaceful demonstrations is of interest to law enforcement or concerns “homeland security” in any way.

“This production of documents, like the FBI documents that the PCJF received in December 2012, is a window into the nationwide scope of DHS and FBI surveillance, monitoring, and reporting on peaceful protestors organizing with the Occupy movement. Taken together, the two sets of documents paint a disturbing picture of federal law enforcement agencies using their vast power in a systematic effort to surveil and disrupt peaceful demonstrations. The federal agencies’ actions were not because Occupy represented a ‘terrorist threat’ or a ‘criminal threat’ but rather because it posed a significant grassroots political challenge to the status quo,” stated Mara Verheyden-Hilliard, Executive Director of the PCJF.

“The documents are heavily redacted and represent, we believe, a fraction of what the government possesses. But these documents show that federal and local law enforcement agencies, in concert with the biggest banks on Wall Street and elsewhere in the country, conducted a massive spying program and a large-scale disruption operation against the Occupy movement.” stated Carl Messineo, Legal Director of the PCJF.

Boston counterterror unit tracked protesters

In the fall of 2011, a key Boston police counterterror intelligence unit — funded with millions of dollars in U.S. homeland security grants — was closely monitoring anti-Wall Street demonstrations, including tracking the Facebook pages and websites of the protesters and writing reports on the potential impact on “commercial and financial sector assets” in downtown areas, according to internal police documents.

The police monitoring of the activities of Occupy Boston — an off-shoot of the Occupy Wall Street protests that swept the country in 2011 — came during a period after the U.S. government received the second of two warnings from the Russian government about the radical Islamic ties of alleged Boston Marathon bomber Tamerlan Tsarnaev.

Boston Police Commissioner Ed Davis told a congressional panel Thursday that his department was never alerted by any federal agency to the information about Tsarnaev, but added that it was “hard to say” whether it would have made any difference in preventing the bombing. FBI  officials have insisted that the intelligence about Tsarnaev was vague and uncorroborated and that their own assessment at the time produced no “derogatory” information that justified opening a full-scale investigation.

But the internal Boston police documents, recently obtained by a civil liberties group, could raise fresh questions about the role of Homeland Security-funded “fusion centers” like the Boston Regional Intelligence Center, or BRIC, which conducted the monitoring. The Boston unit  is one of 72 such units set up to collect, analyze and share intelligence about potential terror threats. While  Homeland Security Secretary Janet Napolitano has called the units “one of the centerpieces” of the nation’s counterterrorism efforts, congressional critics have questioned their effectiveness and accused them in some cases of writing “useless” reports that infringed on civil liberties.

“They  were monitoring completely lawful activities,” said Mara Verheyden-Hilliard, executive director of the Partnership for Civil Justice, a civil liberties group that recently obtained the documents on the BRIC’s monitoring of Occupy Boston under the Freedom of Information Act. She said the BRIC monitoring was an example of the “vast expenditure of government money” to collect intelligence on activities unrelated to terrorism, in violation of First Amendment rights.

A Boston police spokeswoman said the department has changed its reporting procedures since the monitoring of the protests and emphasized that the BRIC is “about a lot more than terrorism.”

A Homeland Security official declined comment, saying the BRIC, like other fusion centers, was “locally owned and operated.” But the official noted that, just five days before the marathon bombing, the BRIC did produce an assessment for the event that, while concluding there was “no specific” or “credible” threat information, advised that “officials should be aware of a range of potential terrorist threats, from scattered unsophisticated attacks to dispersal of chemical or biological agents.” The assessment also identified the marathon finish line — where the bombing took place — as well as Fenway Park as “an area of increased vulnerability.”

The internal police documents about the activities of the BRIC show that on Sept. 30, 2011 — just two days after the second Russian warning about Tsarnaev was sent to the CIA — the Boston police unit was focused on an upcoming “Take Back Boston Rally” planned for the city’s Dewey Square.

“Approximately 100 people are listed as attending the Take Back Boston Rally on the event’s Facebook page and Occupy Boston organziers are encouraging people to attend it as well,” reads one BRIC report written by a U.S. homeland security official on Sept. 30, 2011. “The BRIC has received information that approximately 700 people will participate in the Take Back Boston march, with approximately 100 people staying to camp out as part of Occupy Boston.”

A follow-up report, three days days later, tracked the number of protesters, noting that “the size of the camp in Dewey Square has steadily grown over the weekend” and that “according to the group’s website” the demonstrators were planning two marches, including one to a “local media station, very likely to be Fox News Boston on Beacon Hill.”

Verheyden-Hilliard, whose group obtained the documents, said it was not surprising that the BRIC would be reporting such information since later documents appear to show Homeland Security officials requesting such data. In one “Daily Intelligence Briefing,” dated Oct. 21, 2011, the “Threat Management Division” of Homeland Security’s Federal Protective Service outlines a “template for creating the daily intelligence brief for your region” and then cites a “list of events we want to request” that officials submit “for daily briefing information.” Among the categories, in addition to reporting on domestic terrorist acts and “significant criminal activity” is one called “Peaceful Activist Demonstrations.”

In his testimony Thursday, Commissioner Davis acknowledged to a House committee that his department, which runs the BRIC, was never provided any of the intelligence from the FBI and CIA that Tsarnaev, a resident of Cambridge, had been twice flagged by the Russians as an Islamic radical with ties to “underground” groups in that country.

“We were not aware of the two brothers,” Davis said in response to questioning by Rep. Mike McCaul of Texas, chairman of the House Homeland Security Committee. “We were not aware of Tamerlan’s activities.”

Davis acknowledged that police counterterrorism detectives were assigned to an FBI Joint Terrorism Task Force (JTTF) — a separate unit from the Homeland Security fusion centers that serves as the government’s primary investigative arm for probing terror threats. An FBI agent at the Boston JTTF conducted an “assessment” of Tsarnaev in 2011 after the first warning about his ties was sent by Russia’s FSB intelligence service. The assessment found no “derogatory” information about Tsarnaev that justified conducting a formal investigation. Later information about Tsarnaev included a second Russian warning to the CIA on Sept. 28, 2011.

But while Boston police had access to the JTTF’s classified database, Davis said that his own officers assigned to the task force were never  specifically alerted to any the information about Tsarnaev. “They tell me they received no word about that individual prior to the bombing.”

FBI spokesman Jason Pack said Thursday that state and local members of the JTTF are “responsible for maintaining awareness of possible threats” in their areas and could have performed “customized key word searches” of the FBI database that would have yielded the information about Tsarnaev.

In these post-constitutional days it’s not just the government that is out to violate your rights. Count on Corporate America to be a co-conspirator.

In one-two knock-out punch to the Fourth Amendment, officials within the Obama Administration have secretly authorized major telecom firms to intercept communications carried on portions of their networks, C/NET reports, noting that the practice, under federal wiretapping laws, would otherwise be illegal. Carriers include AT&T and other major ISPs – Internet service providers.

Per C/NET:

The secret legal authorization from the Justice Department originally applied to a cybersecurity pilot project in which the military monitored defense contractors’ Internet links. Since then, however, the program has been expanded by President Obama to cover all critical infrastructure sectors including energy, healthcare, and finance starting June 12.

(Question: Before entering politics, wasn’t President Obama some sort of constitutional professor? I’m just asking because that seems relevant here – and because no one in the Praetorian Washington Press Corps is going to. And what copy of the Bill of Rights is Attorney General Eric Holder using?)

‘Alarm bells should be going off’

The justification for this blatant privacy violation, of course, is the same that it always is: It’s for our own safety. But that excuse is just a smokescreen, as Marc Rotenberg, executive director of the Electronic Privacy Information Center, observes.

“The Justice Department is helping private companies evade federal wiretap laws,” he said. Rotenberg’s organization obtained over 1,000 pages of internal government documents and provided them to C/NET.

“Alarm bells should be going off,” he told the online magazine.

According to the report, the documents showed that the National Security Agency (NSA), which is located on the grounds of Ft. Meade, Md., and the Defense Department were heavily involved in lobbying for the secret legal authorization. NSA Director Keith Alexander actually participated in some of the discussions personally.

“Despite initial reservations, including from industry participants, Justice Department attorneys eventually signed off on the project,” C/NET said, indicating that Justice officials knew good and well what NSA and DoD was requesting was unconstitutional – that is, before they decided to play along.

As part of the agreement, the Justice Department said it will grant legal immunity to any participating network providers, backed up with what participants in the confidential discussions said were “2511 letters,” in reference to the Wiretap Act codified at 18 USC 2511 in federal statutes.

“The Wiretap Act,” C/NET reported, “limits the ability of Internet providers to eavesdrop on network traffic except when monitoring is a ‘necessary incident’ to providing the service or it takes place with a user’s ‘lawful consent.'”

Apparently not.

No help from Congress

One industry rep told the online magazine that the 2511 letters give ISPs legal immunity – stay-out-of-jail cards, if you will – and a promise from the Justice Department not to prosecute them for any criminal violations of the Wiretap Act. C/NET said it wasn’t clear how many of the 2511s were issued.

Deputy Secretary of Defense William Lynn, in 2011, publicly disclosed some details of the original project, called the DIB Cyber Pilot. In May 2012, the project was transformed into an ongoing program, which was much broader but still voluntary. It was then the Department of Homeland Security became involved in it for the first time. Renamed the Enhanced Cybersecurity Services program in January, it is currently being expanded once again, this time to all tech and information firms that operate “critical” infrastructure.

If you’re wondering why Congress isn’t outraged and taking action, you should know that this is likely being done with tacit congressional approval. Both the House and Senate intelligence committees, in their oversight role, have almost certainly been briefed about this little Fourth Amendment violation, so don’t expect any help from the Legislative Branch – though clearly Congress has a role, as well as a duty to act. Last month the non-partisan Congressional Research Service published a report concluding the Executive Branch most likely does not have the authority to circumvent the Privacy Act unless Congress changes the law.

I wouldn’t hold my breath if I were you.
